INDIGO SKY SOLUTIONS LTD – TERMS & CONDITIONS

 All prices quoted are EXCLUSIVE of VAT which will be charged at the current standard rate of 20%.

 INSTRUCTION OF WORKS

 An instruction of works ie for us to carry out work which may require any of our services is classed as one of the following: verbal, written, via any social media format/application.  By doing so, you are entering into a contractual agreement with Indigo Sky Solutions Ltd or one of it’s subsidiaries for us to carry out our services in exchange for payment and within the terms set out below.  We will seek to recover payment for an instruction completed or part thereof should there be a change of mind or withdrawal to correspond.

 PAYMENTS

Unless credit terms have been agreed, advance payment is expected by the customer.  Works will be undertaken once payment is received.  If later than expected or agreed payment is received, then please be aware that delivery dates may also be adjusted to fall in line with said late payment.

 Standard payments can be made by bank transfer – details are provided with your order confirmation and/or invoice prior to works beginning.

 If paying by cheque, clearance is required before goods are released (reasonably expect 4 days for clearance). Payment can be made by credit or debit card – please do so by calling us on: 0121 558 0922 during office hours.

 The title of all and any goods remain with Indigo Sky Solutions Ltd until full payment is received. Any issue regarding invoiced amounts or details you are not happy with should be raised within 14 days of receipt of goods and/or invoice. Where third parties are engaged and hence we are committing to a liability with them, note that payment may be required in advance of works beginning.

 Changed your mind?  No problem, we will only charge for works carried out so far, or will refund any payments/part payments at the discretion of Indigo Sky Solutions Ltd depending upon the time spent and works already carried out at the point of the instruction changing.

 CREDIT

Credit accounts are available upon application for product transactions/sales. Please call or email us to discuss your requirements.  Contact details are available via our website contact page. 

 TURNAROUND TIMES

Whilst we will always work to meet your timelines where possible this cannot always be guaranteed. We cannot accept liability for delays beyond our control. We will not be liable if we are unable to perform our obligations under these terms and conditions due to the failure of any machine, data processing system or transmission link or to any circumstances beyond our control (including but not limited to strike, industrial action, natural causes, war, fire, or prohibition or enactment of any kind). Indigo Sky Solutions Ltd cannot accept liability for consequential loss. 

CARRIAGE & DELIVERY INFORMATION
We would normally organise next working day delivery with our preferred couriers. For urgent or valuable items we recommend a dedicated same day service. Carriage costs & packing is charged onto the customer at cost/kept to a minimum. The exact cost would depend on the weight and volume of those goods. We would recommend that you request an estimate before placing an order. We endeavor to deliver works on or before agreed dates, but as we are sometimes governed by 3rd party couriers we cannot guarantee delivery times.

 DAMAGED IN TRANSIT

In the unlikely event that this happens, it’s imperative that you sign for them as “damaged”. Please take photographs as this will assist in us being able to claim compensation from the carrier. Unless you take reasonable precautions when signing for goods we may be unable to entertain a damage claim.  Any issues regarding damaged goods must be highlighted within the first 48 hrs of delivery.

 DEFECTS TO PRINT/OTHER GOODS

If you are not entirely satisfied with your goods it is essential that you contact us straight away. Claims made later than 7 days from delivery won’t be entertained. We print or embroider garments provided by ourselves/our approved third party suppliers only.  Decoration to client’s own garments are made at the owner’s discretion, we do not guarantee or insure garments not provided by us.

All material on this website and any other works produced by/on behalf of Indigo Sky Solutions Ltd is the copyright material of Indigo Sky Solutions Ltd. Copying or adaptation of the material on this website, subsequent websites owned within the Indigo Sky Solutions Ltd business or it’s incorporation into any other work by any means is prohibited, unless prior written agreement is provided by Indigo Sky Solutions Ltd. No rights are granted in respect of copyrighted material. All trade marks, service marks and trading names on this website are the property of Indigo Sky Solutions Ltd (or its licensor) and may not be used, reproduced, published, uploaded, posted, transmitted, modified or transmitted in any way (other than for viewing the website or ordering our products).  Please request any print-ready artwork materials or assets within 30 days of completion.  Due to the nature of our business and the volume of files we work on, we may remove files from our network and/or archives (and hence no longer have access to).  By working with us, you are agreeing to these terms and conditions.  PROOF APPROVAL

Indigo Sky Solutions Ltd provide proofs for all potential works, occasionally there is an exception to this rule which is usually based on last minute lead times.  Upon proof approval and/or the signing of a work order, including by email or any other type of written communication, customers are agreeing to Terms and Conditions set by Indigo Sky Solutions Ltd. We recommend that you take the time and effort to carefully check proofs sent to you for approval – including: spellings, errors, differing colours and anything else that may impact on your finished product.  Indigo Sky Solutions Ltd do not guarantee amendment or accept responsibility for amendments once approval has been received – whichever format that may be, ie: verbal or in writing (which can include those by text, email and/or any other digital or written format).

 TERMINATION OF WORKS

If termination instructions are received from a client, payment in full for the works already carried out and any outlay already made by ourselves will be expected. Indigo Sky Solutions Ltd reserves the right to terminate works at their discretion if felt threatened.  Inappropriate language, attitude or behaviour will not be tolerated across any areas of the business.

 MARKETING

Indigo Sky Solutions Ltd have the right to display or refer to works created for/on behalf of the client as examples of our work. We may include works we produce for marketing purposes.  Please advise us at the beginning of our working agreement if this is not appropriate for you or your business.  

PRIVACY POLICY

Indigo Sky Solutions Ltd (the “Company”) is committed to maintaining robust privacy protections for its users. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service.  

For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at www.indigoskysolutions.com

“Service” refers to the Company’s services accessed via the Site, ie: Graphic Design,Web Development & Maintenance, Print, Promotional Merchandise, Workwear & Uniforms.

 The terms “we,” “us,” and “our” refer to the Company.

 “You” refers to you, as a user of our Site or our Service. 

 By accessing our Site or our Service, you accept our Privacy Policy and Terms of Use (found separately on our website), and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy.

Indigo Sky Solutions Ltd collects “Non-Personal Information” and “Personal Information” in the categories described below:

 Usage data

Indigo Sky Solutions Ltd will process information about your use of our website and services (“usage data”). The usage data may include

The source of the usage data is provided by Google Analytics. The usage data collected is required to:

(2) optimise the content of our website as well as any advertisement

(3) ensure the long-term viability of our information technology systems and website technology

(4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack.

 In order to process this information, we have obtained the user’s consent.

 Notification data

Indigo Sky Solutions Ltd may process information that you provide to us for the purpose of subscribing to our email notifications and/or newsletters (“notification data”). Our newsletter may only be received by the user if 

(1) the user has a valid email address and 

(2) the user registers for the newsletter shipping. 

A confirmation email will be sent to the email address registered by a user for the first time for newsletter shipping, for legal reasons, in a double opt-in procedure. The confirmation email is used to prove whether the owner of the email address as the user is authorised to receive the newsletter.

 When the user registers for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the user at the time of the registration, as well as the date and time of the registration. The purpose of the collection of this data is to legally protect Indigo Sky Solutions Ltd by ensuring understanding of the possible misuse of the email address of a user at a later date. The personal information collected as part of a registration for the newsletter will only be used to send our newsletter.

 The subscription to the newsletter may be terminated by the user at any time. The consent to the storage of personal data, which the user has given prior to the shipping of the newsletter, may be revoked at any time. For the purpose of revoking consent, a corresponding link for unsubscribing is found in each newsletter.

 Enquiry data, correspondence data and customer relationship data

Indigo Sky Solutions Ltd may process information contained in any enquiry you submit to us regarding our services and products (“enquiry data”). If a user contacts us via email or via a contact form, the personal information transmitted by the user is automatically stored.

(3) the name of the user’s employer

Indigo Sky Solutions Ltd may process information that the users post for publication on our website or through our services (“publication data”). On our website the users can post information in the following ways ie:

Indigo Sky Solutions Ltd may process information that relates to transactions, including purchases of goods and services, that the user enters into with us and/or through our website (“transaction data”). The transaction data may include:

(3) the transaction details with regards to the purchase

 We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding your payments and dealing with queries relating to your payments and refunds.

 HOW WE USE AND SHARE INFORMATION

 Personal Information

We may share Personal Information with vendors and/or our business partners who are performing services for the Company, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.  An example of this would be a delivery address for your to receive ordered items.

 In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.

 Non-Personal Information

In general, we use Non-Personal Information to help us improve the Service and customise the user experience. We also aggregate Non-Personal Information in order to track trends and analyse use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.

 RETAINING AND DELETING YOUR PERSONAL INFORMATION

The personal information that we process for any purpose or purposes will not be kept for longer than is necessary for the expressed purpose. We will retain your personal data as follows:

 Name, address, email address, IP addresses, these will be retained for the amount of time it takes to process our services for you, for the duration of the time that we work together, or until you ask us to remove your contact details from our database.
